2. Scope

  1. These Beta Terms of Use govern the use of the beta version of Blazelock by registered users.
  2. The beta is intended primarily for business users. Use by consumers is not excluded.
  3. If a user registers for or uses Blazelock on behalf of a company or other organization, that user confirms that they are authorized to do so.

3. Contract formation and acceptance

  1. Use of the beta is currently available only to enabled users.
  2. By registering, you agree to these Beta Terms of Use and to Blazelock's Privacy Policy.
  3. These Beta Terms of Use apply from completion of registration and for the entire duration of beta use.

4. Subject matter of the beta

  1. Blazelock is provided as part of a free beta version.
  2. The beta may be used in production.
  3. The specific scope of features may change at any time during the beta.
  4. There is no entitlement to the continued availability of specific functions, integrations, interfaces, processes, or properties.

5. Price, end of beta, and future paid offering

  1. The beta is free of charge.
  2. Use of the beta does not create any automatic entitlement to enter into a paid contract.
  3. Any future paid offering of Blazelock requires a separate agreement.
  4. Beta users will receive a separate discount when a paid offering is publicly launched, subject to Blazelock's offer applicable at that time.
  5. There is no entitlement to a specific discount level or pricing structure.

6. Fair use

  1. Use of the beta is subject to the fair use principle.
  2. In particular, fair use means that the beta may not be used to an extent that impairs the stability, performance, or availability of Blazelock for other users or is economically unreasonable for Blazelock.
  3. Blazelock is entitled to define, change, reduce, or adjust on a case-by-case basis usage limits, technical limits, volumes, rates, integration limits, and other operational thresholds at any time.
  4. Blazelock is also entitled to throttle requests, restrict functions, or suspend access in whole or in part in the event of excessive use, load spikes, security risks, or other operational necessity.

7. Permitted use

  1. Users may use Blazelock within the scope of the provided functions for their own business, professional, private, or other lawful purposes.
  2. Use also includes real production files and, within legitimate use cases, malware samples.
  3. For testing purposes, Blazelock expressly recommends using the test files provided in the documentation.
  4. Users may only transmit to or process with Blazelock such files, content, and data that they are authorized to use, process, and transmit.
  5. Any abusive or unlawful use of Blazelock is prohibited.
  6. This includes, in particular, attacks on Blazelock, the circumvention or impairment of technical protective measures, the intentional disruption of operations, abusive overloading of the systems, and any other actions that may endanger or harm Blazelock, other users, or third parties.

8. Files, scan results, and user responsibility

  1. Blazelock supports the detection of potentially harmful files. However, complete detection of all malware and error-free scan results at all times cannot be guaranteed.
  2. Decisions, actions, and assessments based on scan results are the sole responsibility of the user.
  3. This also applies where Blazelock uses third-party scan engines, review procedures, or technical detection mechanisms.

9. Availability, changes, and beta nature

  1. The beta is provided in its current version from time to time.
  2. The beta is provided as a beta version and is therefore in a stage of development and testing.
  3. There is no entitlement to uninterrupted availability, freedom from errors, performance, compatibility, or specific response times.
  4. Maintenance, interruptions, restrictions, delays, functional changes, and outages may occur at any time.
  5. Blazelock is entitled to modify, further develop, restrict, suspend, or discontinue the beta or individual functions at any time.

10. Support

  1. Support during the beta is provided subject to availability and without any service level agreement.
  2. No specific response times, processing times, or success commitments are guaranteed.
  3. Blazelock may change support channels, support scope, and support processes at any time.

11. Confidentiality of the invite-only beta

  1. To the extent that non-public information about Blazelock is made available to the user as part of the beta, such information must be treated as confidential.
  2. This includes, in particular, non-public product details, access credentials, security information, unpublished benchmarks, and non-publicly known vulnerabilities.
  3. Such information may not be publicly shared, published, or disclosed to third parties without Blazelock's prior consent, unless disclosure is legally required.
  4. This does not affect the coordinated reporting of security vulnerabilities to Blazelock.

12. Data processing and file storage

  1. The processing of personal data is additionally governed by Blazelock's Privacy Policy.
  2. Uploaded files are generally deleted from Blazelock's systems once the relevant scan process has been completed.
  3. Notwithstanding the above, scan-related metadata, findings, log data, technical event data, account-related data, and organization-related data may be retained.
  4. Unless a user deletes their account or organization themselves and no legal or operational deletion is required, such data may continue to be stored beyond the end of the beta and carried over into a later product offering.

13. Feedback

  1. Users may provide Blazelock with feedback, comments, suggestions for improvement, ideas, or bug reports at any time.
  2. Blazelock may use such feedback free of charge and without time limit for the further development, improvement, and operation of Blazelock.
  3. There is no entitlement to compensation, attribution, or separate consent for the use of such feedback.

14. Suspension and termination

  1. Users may stop using the beta at any time.
  2. Blazelock may suspend, restrict, or terminate beta access in whole or in part if there is an objective reason for doing so.
  3. An objective reason exists in particular in the event of security risks, abuse, unlawful use, violations of these terms, operational necessity, fair use violations, technical overload, or economic unreasonableness.
  4. Blazelock may also terminate the beta in whole or in part at any time.
  5. A suspension, restriction, or termination of the beta does not give rise to any claim for continuation, restoration, or unchanged provision of the beta.
  6. Any later use of a paid offering from Blazelock remains unaffected and is subject to a separate agreement.

15. Warranty

  1. Blazelock gives no warranty that the beta will be available at all times, error-free, uninterrupted, secure, or suitable for a particular purpose.
  2. Mandatory statutory rights remain unaffected.

16. Liability

  1. Blazelock shall have unlimited liability for intent, gross negligence, and culpable injury to life, body, or health.
  2. In the event of a slightly negligent breach of essential contractual obligations, Blazelock's liability is limited to the typical and foreseeable damage. Essential contractual obligations are obligations whose performance is necessary for the proper conduct of the beta use and on whose compliance the user may regularly rely.
  3. Otherwise, Blazelock's liability for slight negligence is excluded.
  4. To the extent permitted by law, liability for indirect damages, consequential damages, loss of profit, unrealized savings, and data loss is excluded.
  5. The above limitations of liability also apply in favor of Blazelock's legal representatives, executive bodies, employees, and agents.

17. Amendments to these Beta Terms of Use

  1. Blazelock is entitled to amend these Beta Terms of Use with effect for the future if there is an objective reason for doing so.
  2. An objective reason exists in particular in the event of changes to the beta, the security situation, the legal situation, technical framework conditions, or the business model.
  3. Any amendments will be communicated to the user by email, within the product, or by other appropriate means.
  4. If the user continues to use Blazelock after the communicated amendments have taken effect, this shall be deemed acceptance of the amended Beta Terms of Use.

18. Applicable law and jurisdiction

  1. The law of the Federal Republic of Germany applies.
  2. In addition, consumers are protected by the mandatory consumer protection provisions of their country of habitual residence.
  3. To the extent permitted by law, the place of jurisdiction is Herford.

19. Language versions

  1. These Beta Terms of Use may be provided in multiple language versions.
  2. The German version alone shall be authoritative.
  3. Any other language versions are for information purposes only.

20. Final provisions

  1. Should any provision of these Beta Terms of Use be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
  2. The invalid provision shall be replaced by the statutory provision.
